These terms are an agreement between you and Flexoraa. They cover two things: use of our website, and the licence you receive when you buy the Flexoraa theme. By using the website or installing the theme, you accept them.

Part A. The website

1. Using the site

You may browse www.flexoraatheme.com and our documentation for your own business purposes. You may not attempt to break into it, disrupt it, scrape it at a scale that burdens it, or use it to do anything unlawful.

2. Our content

The text, design, images, demo content and documentation on the website belong to Flexoraa or our licensors. You may not copy or republish them except as these terms allow for the theme itself.

3. Availability

We try to keep the site up but do not promise uninterrupted access. We may change or withdraw parts of it.

Part B. The theme licence

4. What you are buying

A licence to use the Flexoraa theme on HubSpot CMS. You are not buying ownership. Flexoraa retains all rights that these terms do not expressly grant you.

5. Scope of the licence

Subject to payment, we grant you a perpetual, worldwide, non exclusive, non transferable licence to install and use one copy of the theme on one HubSpot portal, for one website, whether that portal is yours or a client's.

Each additional portal needs its own licence.

6. What the licence includes

As at version 2.0.0, the theme contains:

• 42 modules
• 15 website page templates
• 1 blog listing template and 4 blog post layouts
• 7 system page templates
• 31 drag and drop sections
• 3 form styles
• light and dark colour schemes

We may add to or change this over time. The list describes the current release, not a promise of future contents.

7. What you may do

• build a website for yourself or for a client on the licensed portal
• edit the theme's templates, modules, styles and code to suit that website
• keep using the version you have, for as long as you like

8. What you may not do

• install the theme on more portals than you hold licences for
• resell, sublicense, rent, share or give away the theme, whether modified or not
• include it in another theme, template, product or bundle offered to third parties
• publish its source, in whole or in substantial part, anywhere public
• remove copyright or licence notices from its files

Handing a finished website over to the client whose portal it is licensed for is fine. Handing over the theme itself, for them to reuse elsewhere, is not.

9. Updates and support

Updates are included for as long as we maintain the theme. There is nothing to renew and no recurring fee.

Support covers the theme as we ship it. It does not cover custom code you or a third party added, HubSpot platform problems, or general web development help.

We may stop maintaining the theme. If we do, your licence to keep using the version you already have continues.

10. Price, payment and refunds

Through the HubSpot Marketplace. HubSpot takes the payment and is the party you transact with for billing purposes. Payment, invoicing and refunds for these purchases are handled by HubSpot and are subject to HubSpot's own terms and refund policy. We never receive or store your card details.

Payment is processed by PayPal. We never receive or store your card or bank details. PayPal shows us the payer name, email address and transaction reference so that we can identify your purchase and issue your licence.

For purchases we offer a refund within 7 days of purchase if the theme does not work as described and we cannot fix the problem for you. Because the theme is a digital product delivered immediately, we cannot offer refunds simply because you changed your mind after downloading it, except where consumer law in your country gives you that right.

11. Third party components

The theme includes third party code, each under its own licence. Those licences govern that code, and nothing in these terms takes away rights they grant you.

All bundled third party code is MIT licensed.

12. Warranties and disclaimer

We provide the theme with reasonable skill and care, and we warrant that we have the right to license it to you.

Beyond that, the theme is provided "as is". We do not warrant that it will be free of bugs, that it will work with every HubSpot plan, integration or third party module, or that it will meet a particular requirement of yours. HubSpot is a platform we do not control, and changes there may affect the theme.

Nothing in these terms excludes liability that cannot lawfully be excluded.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, revenue, data or goodwill, however caused.

Our total liability arising out of or in connection with these terms is limited to the amount you paid for the licence in question.

14. Termination

Your licence ends if you materially breach these terms and do not put it right within 30 days of us telling you. On termination you must stop using the theme and remove it from your portals. Sections that by their nature should survive, such as restrictions, disclaimers and liability, survive termination.

15. Changes to these terms

We may update these terms for future purchases. The terms you accepted at the time of your purchase continue to govern that purchase.
